GUARANTEE TERMS
We require a $250 non-refundable deposit to hold a puppy until it's ready to go at eight weeks. If you're interested in a puppy, it could still sell at any time until you send me proof that you have sent a deposit. Balance is due in cash when you come to get your puppy. We also offer personal delivery at buyer's expense. WE DO NOT SHIP BY AIR OR BY GROUND PET TRANSPORTS. Below is our pet guarantee.
CARDINAL HILL TERRIERS HEALTH GUARANTEE/PET CONTRACT
NOTE TO PURCHASE OF GOOD FAITH: All canines have the potential for genetic or congenital disease. Due to the nature of some diseases, they cannot always be eliminated. It is the job of the Breeder, through selective breeding, to try and minimize (not eliminate) these conditions -- in good faith. Please read, to your full understanding, the following sections of this Health Guarantee and Sales Agreement concerning contagious or hereditary defects.
Cardinal Hill Terriers shall hereinafter be referred to as the “Breeder”. The original purchasing party, and solely the original purchasing party shall hereinafter be referred to as the “Purchaser”.
We do our best to make sure all pups are free of problems at the time of sale. This Guarantee does not cover any of the following treatable conditions that may crop up after the sale: Internal or external parasites (Coccidiosis, Giardia, Any type of worms, Ear or Skin Mites, Sarcoptic or Cheyletiella mange). After date of purchase, this guarantee does not cover Hypoglycemia, Kennel Cough, Pneumonia, Allergies (food or skin (unless skin is severe)), inguinal or umbilical hernias, Elongated Soft Palate, Undescended Testes, Luxated Patellas grade 1-2. This Guarantee does not cover ANY veterinarian costs associated with care of pup. This Guarantee does not cover elective surgeries. No Guarantee against contagious illnesses common to pups such as parvo or distemper, unless said illness is proven to come from Breeder's facility and pup dies of said illness within ten days after purchase.
The Purchaser is responsible for the daily health care and maintenance of pup, including all immunizations and examinations due after purchase, and providing necessary medication and follow-up treatments as veterinarian recommends or Guarantee is void. Purchaser must keep records from veterinarian.
In the event of serious genetic defect making pup unsuitable as pet, the Breeder shall replace pup with another pup of equal value within 175 days, upon return of defective pup and all pup's original paperwork. If the Purchaser declines the replacement pup, then the Breeder and Purchaser shall be under no further obligation and it will be deemed that the Purchaser has released the Breeder from any and all further claims. Purchaser must return pup and pick up replacement pup at the Breeder's home. (in event of genetic defect, several points in this paragraph can be negotiated at buyer's discretion). NO PUP MAY BE EUTHANIZED WITHOUT BREEDER'S PERMISSION UNLESS DEEMED BY VET TO BE REQUIRED DONE IMMEDIATELY!
This Health Guarantee is forfeited if the pup is fed a raw or homemade diet, pup must be fed an age appropriate premium brand puppy food for the first year.
This pup is being sold as a pet/companion only, no guarantee is made as to the disposition, conformation, temperament, size, weight, color or markings of pup. No guarantee is made as to how quickly pup trains. No guarantee is made for any other traits that may develop as the puppy grows up. Health Guarantee is null and void if the pup is used for breeding.
The Breeder is always willing to accept a pup back in any event (allergy, Landlord/Tenant issues, marital or adjustment problems, relocation, etc) but will not guarantee any monetary refund (but a partial refund may be possible at buyer's discretion).
In the event of litigation pertaining to the pup covered by this Guarantee, both the Breeder and the Purchaser shall assume exclusive responsibility for their own attorney's costs. This Health Guarantee is hereby entered into exclusively and wholly executed in the State of MISSOURI and litigation arising from any possible breach of this Health Guarantee and Sales Agreement shall be exclusively adjudicated in the County of CALLAWAY, in the State of MISSOURI, exclusively under MISSOURI law. All parties hereby submit themselves to the exclusive jurisdiction of said courts. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions shall not be affected. This is the total agreement between Cardinal Hill Terriers and the Purchaser and no other terms or conditions shall be valid to this sale unless added to this contract and both parties have signed changes. The Purchaser acknowledges that he or she has read, understands and agrees to the terms of this Health Guarantee and Sales Agreement. This written agreement is a binding legal contract entered into in the State of MISSOURI, County of CALLAWAY, according to and by Cardinal Hill Terriers Health Guarantee and Sales Agreement.
